Injury to Feelings Claims: NFPS 2006
Members are well aware that the Union has fought and won a claim concerning age discrimination arising from the pension changes made in 2015. The claimants in the legal proceedings were all members of the FPS 1992.
Members of the New Firefighters’ Pension Scheme 2006 (NFPS) also benefit from the primary outcome of the claim. When they take their benefits, they will be offered a choice: they can choose to have the pension they accrued between 1 April 2015 and the date they were transferred to the 2015 Scheme treated as membership of the NFPS or as membership of the 2015 Scheme.
FPS members also have strong claims for compensation for injury to feelings. So do retained firefighters who joined the NFPS on the terms of the Modified NFPS, which broadly matches the FPS. Injury to feelings claims for NFPS members who are not on the Modified NFPS terms are more complicated, and our legal advisers are writing to all NFPS members who completed the surveys that went up on the union’s website to explain why. Because we do not want the Government Legal Department to know what advice we have received, it is preferable that this information is sent to affected members personally rather than put it in a publicly accessible circular.
